Preamble
This document governs the terms and conditions of the luggage storage service via automated lockers (“Smart Lockers”) provided by Michele Giglio S.n.c., VAT no. 03345900827, registered office at Piazza Mordini 3, Palermo, e-mail info@palermolocker.com (hereinafter, “the Company”), operator of the “Palermo Locker” service and of the website https://palermolocker.com, carrying out its activity at Via Simone Corleo 24, 90139 Palermo (PA), Italy.
These “Terms and Conditions of Service” form an integral part of every individual storage contract and of any other service concluded with the Customer and may not be separated from the contract itself.
The following definitions apply:
- “we”, “us”, “our”, the “Company” means Michele Giglio S.n.c. and any of its partners and collaborators;
- “Customer(s)”, “you” and “your” means the person using the service, with or without a confirmed reservation on https://palermolocker.com.
1. Subject of the Service
The service consists of making automated lockers (“Smart Lockers”) available to the Customer, for a fee, for the storage of their luggage and personal belongings, for the period selected at the time of booking or of purchase at the on-site totem and confirmed by e-mail and/or SMS.
The service is self-service: the Customer deposits and collects their luggage independently using the access code provided. The system automatically assigns an available locker of the selected size.
2. Booking, Payment and exclusion of the Right of Withdrawal
- Bookings can be made on the website 24 hours a day; deposit is permitted within the 07:00–23:00 time slot. Outside this slot, access to the premises is in no case possible.
- Payment is due at the time of booking or of purchasing the service at the totem. The amount covers the cost of the selected size and time slot. Rates are available on the website.
- The confirmation e-mail and/or SMS sent following payment constitutes confirmation of the booking.
- The service refers to a specific date and time slot: therefore, pursuant to Art. 59(n) of the Italian Consumer Code, the right of withdrawal does not apply.
- The booking is non-refundable, except for malfunctions attributable to the Company.
3. Access to the Service
- The service is accessible exclusively via the opening code provided to the Customer.
- The premises are open seven days a week; access hours are from 07:00 to 23:00.
- The Customer is responsible for safeguarding the code and for the correct use of the locker.
- Access is permitted to adults or to accompanied minors.
- During the storage period, the locker may be accessed to collect or deposit other personal belongings at no additional cost.
- The premises are equipped with security systems (alarm and video surveillance).
4. Restrictions and Permitted Use
Smoking is prohibited within the luggage storage premises.
The following items may not be deposited in the Smart Lockers:
- animals, live or dead;
- firearms and/or bladed weapons, ammunition and explosives, flammable, hazardous or illegal materials;
- narcotic and psychotropic substances;
- cash, payment cards, valuables and securities;
- jewellery, metals, precious stones, watches;
- works of art and antiques, goods of particular value;
- media containing high-value information and/or sensitive data;
- pornographic or indecent material;
- perishable food;
- waste;
- plants.
The deposit of technological devices (phones, tablets, PCs, smartphones) is permitted, but the Customer assumes full risk, being aware of and accepting that the maximum indemnity value for the contents of a single Smart Locker is set at € 1,000.00 (see Article 9).
It is the Customer’s responsibility not to leave prohibited or particularly valuable items. The Company is not liable for items of this nature placed in the locker.
Maximum weight: the maximum permitted weight per locker is 35 kg. No complaints or refund requests will be accepted for luggage exceeding the permitted dimensions or weight.
5. Customer’s Obligations and Responsibilities
The Customer undertakes to:
- check the weight and dimensions of the luggage before booking (max 35 kg per locker). Should damage to the locker occur as a result of depositing luggage exceeding the permitted weight and/or size, the Company shall be entitled to claim the relevant compensation from the Customer. Forcing the locker closed due to overfilling prevents automatic reopening: the cost of manually opening the locker, equal to € 250.00, will be charged entirely to the Customer;
- close the locker properly before leaving;
- not leave identity documents required for travel inside the locker;
- verify that nothing is left inside the locker at the end of the booking;
- upon final collection, close the locker properly and verify that the deposit is correctly concluded. Failing to conclude the deposit will result in charges, to the card used for payment, for the hours during which the locker was unusable due to the error;
- collect the luggage within the scheduled time. Otherwise, the surcharges indicated in point 6 will apply.
The Customer is liable for damage caused by improper use of the lockers or by depositing prohibited items. In no case shall the Company be held liable for the Customer’s negligence.
6. Late Collection, forgotten and/or abandoned luggage
- In the event of collection beyond the booked time, the Company will charge a surcharge for each hour or fraction of an hour of delay, applying the “Extra hours cost” rate indicated on the website.
- If the luggage is not collected within 72 hours, contact will be attempted with the Customer by e-mail/phone to request removal of the item.
- After 10 days without claim, the item will be deemed abandoned and will be handed over to the public security authorities.
- If shipment of a forgotten item is requested, the Customer bears all shipping costs.
- All further storage and handling costs will be borne by the Customer.
7. Malfunctions
In the event of technical problems preventing the use of the locker, the Company will provide assistance and, where due, a refund or voucher.
No refunds are due for Customer errors in selecting the time slot or locker size.
8. Right of Inspection
The Customer acknowledges and accepts that the Company may open the locker in the event of a technical fault, and may also open the locker and/or the luggage in the event of:
- an order from the Authorities;
- reasonable suspicion of danger or the presence of prohibited material;
- failure to collect upon expiry of the 72 hours following the booked period.
9. Company Liability and Insurance
The Company has taken out an insurance policy against theft and damage to luggage for a maximum value of € 1,000.00 per rented locker, with a 10% deductible. In the event of a claim, it is necessary to prove the value of the personal belongings for which compensation is sought. The prohibited items indicated in point 4 are excluded from cover.
In no case shall the Company be held liable for damage resulting from the Customer’s breaches and/or negligent conduct (by way of example: theft in the event of the Customer’s failure to close the locker properly).
Indirect or consequential damages (e.g. missed flight, travel costs) are not covered by insurance.
10. Complaints and Claims
Any complaints regarding service disruptions and any claims (damage to and/or theft of luggage) must be sent within 3 days of the end of the service to the e-mail address info@palermolocker.com.
The complaint must contain:
- Customer details;
- booking code;
- description and value of the damage;
- documentary and photographic evidence.
11. Severability and Applicable Law
Should any clause of this contract be declared null or ineffective, such nullity or ineffectiveness shall not extend to the other contractual provisions, which shall remain fully valid and effective.
The contract is governed by Italian law. For any dispute, the court of the Customer’s place of residence or domicile, if a consumer, shall have jurisdiction pursuant to the Italian Consumer Code.
